There are many (as in lots of) fact checked 'tales' which reflect the Buckley epitaph; alas there is not, outside of a million dollar legal battle, a platform to have these cases examined. That aside, the larger question (IMO) is 'motivation'. The how of it is immaterial, it is the 'why' that matters. Which, in turn, begs the question 'to what purpose'? For example; the recent fatal events in Broome and the Croc Jock saga. There was, in both cases a clear, distinct warning bell screaming its head off. Not once did CASA step in and bring the full weight of operational knowledge, legal requirements or even a quiet word leading to an attitude adjustment to bear; nothing of significance anyway. Result death and increased danger to the public, passengers and crews. Clear and present danger, blithely ignored. Yet, there are many cases where CASA have moved heaven and earth to demolish operations and individuals out of existence; quite a long list where 'operational safety' may, perhaps, arguably, have been marginally compromised, even some which were 'legal' and 'safe' to any measure that were perused with a vengeance equal to Hell's own Furies and to serve no particular goal or 'safety message'. (Long list available on application). What then was the 'motivation and reasoning behind the relentless persecution and prosecution. Why – and to what end?

Then we turn to the Buckley saga. Whatever the motivation; there was a flight school 'concept' developed up to the 'approval' (acceptance) level by the assessing CASA delegates. To Buckley, there was a line of green lights; all in accordance with Hoyle (he believed). Buckley's version states that both he and the CASA work-crew were all on the same page. Operationally 'sound' and legally acceptable. - So the story goes anyway. The only 'flaw' seems to be (IMO) the 'approach' taken to obtaining final 'approval' and the impediments encountered. I cannot find a document which states the CASA 'objections' on which approval was disallowed. No doubt there is one, a heavy weight one to boot. But Buckley has not, as yet outlined the CASA 'case against' for the flat rejection. History now – however, to me, it seems that the Buckley 'concept/ proposal' had never been 'stepped' through, beginning at the 'top table' starting with an indaba, with the CASA top legal brass. A thumbnail 'dipped in tar' sketch of the proposed operation and the 'legal' ramifications hammered out, long before pen was ever put to paper. With a 'radical' new concept and proposal it is crucial and prudent to garner support and obtain the 'nod' from the gods and accept, in good faith, their advice and 'work-around' proposals. That must beat a no win, no gain to anyone or overall 'safety standards' in very expensive legal brawl: hands down, any day of the week. - Alas, too late now.

CASA is a most extraordinary administration; confounded and dis-functional; Oh, the evidence is there M'Lud, in Spades redoubled. Consider the Croc Jock saga; approved to the point where the Board takes afternoon tea on site and smiles it's beneficence upon all; in the same breath, hammers a new approach to the way flight training is 'managed' in remote country areas; with zero effect on operational 'standards'. From the ridiculous to the 'Cor Blimey' the current governmental management of the aviation industry is in tatters. Time to call in some 'professional help' methinks. IMO and etc.....
